NEWSLETTER SERVICE REGULATIONS – LEGAL AND TAX FLASH FOR BUSINESS

 

§ 1. General provisions

 

  1. These Newsletter Service Regulations, hereinafter referred to as the “Regulations”, set out the terms and conditions of the use of newsletter service, hereinafter referred to as the “Service”, provided by AXELO Ostrowski Domagalski i Wspólnicy sp.k. with its registered office in Rzeszów, al. Tadeusza Rejtana 20, 35-315 Rzeszów, entered into the register of business organizations of the National Court Register kept by the District Court in Rzeszów, 12th Commercial Division under KRS number: 0000535885, NIP [tax identification number]: 8133699440, REGON [National Business Registry Number]: 360354288, hereinafter referred to as the “Service Provider” or “AXELO”.
  2. There Regulations are addressed to the Service Users, being both consumers and entrepreneurs. The provisions of these Regulations are not intended to exclude or limit any consumers’ rights under the mandatory provisions of law – any possible doubts are interpreted in favor of the consumer. If the provisions of these Regulations are inconsistent with the above-mentioned provisions, these provisions will take precedence.
  3. The Service is provided on the Internet in the territory of the Republic of Poland.
  4. The access to the Internet and having e-mail address are necessary to use the Service, however, it is not necessary to fulfil any specific technical requirements, except for having a standard operating system and a standard web browser.

§ 2. Subject of the Service

 

  1. The Subject of the Service is sending the information in the form of an electronic letter (e-mail) to the User, hereinafter referred to as the “Newsletter” via electronic mail to the electronic mail (e-mail address) previously provided by the User.
  2. The information sent in the Newsletter may be of a marketing nature, but also of an informative nature, in particular, this can be information on changes in laws, products or services (e.g. trainings) offered by the Service Provider, also on new products in the offer and current special offers, organized events, promotional activities. The Newsletter may include references to press materials, articles, etc. about the Service Provider and links to websites that are friends of the Service Provider.
  3. By concluding an agreement for the provision of the Service with the Service Provider, the User provides the User’s electronic mail address (e-mail), given in the registration form, in order to receive the Newsletter.
  4. The Newsletter is sent periodically, at least every 14 days.
  5. Each Newsletter contains:
  • information on AXELO as the sender of the Newsletter,
  • the completed field “Subject” indicating the content of the Newsletter,
  • information on the possibility and manner of resigning from the Newsletter service,
  • information on the manner of changing the electronic mail address to which the Newsletter is sent.

 

§ 3. Terms and conditions of using the Service

 

  1. The Newsletter service is free of charge.
  2. The Service can be used by any person that will provide his/her e-mail address on the website under www.axelo.pl in the part concerning the Service, and then, click “Subscribe”. By doing so, the e-mail address provided is sent to the Service Provider and the Service is launched, subject to Paragraph 3.
  3. The Service is launched upon conclusion of the agreement for the use of the Service, i.e. after having read these Regulations and at the moment of checking on the website www.axelo.pl the checkbox with a statement on having read and accepting the terms and conditions of the Service provision.
  4. The User, by using the Service, is obliged to refrain from providing the content of an unlawful nature, in particular from providing other persons’ data without the consent of the authorized persons.
  5. Individual messages, sent as part of the Service, constitute works within the meaning of the copyright and are subject to protection specified in the laws. Any copying, modifying and using in a manner contrary to their intended use or without the Service Provider’s consent may constitute a violation of the law.
  6. The User, from the moment the User starts using the Service, is obliged to observe these Regulations.

 

§ 4. Duration of the Service

 

  1. The agreement for the provision of the Service is concluded for an indefinite period.
  2. The User has the right to terminate the agreement for the provision of the Service without providing any reasons. The termination has immediate effect and does not entail incurring any costs by the User.
  3. The User terminates the agreement for the provision of the Service by sending a statement in that regard to the e-mail address axelo@axelo.pl or by clicking a special link in the Newsletter intended for unsubscribing from the Service.
  4. The Service Provider may at any time suspend or terminate the provision of the Service after prior notification sent to the Users to the e-mail addresses provided by them.
  5. The Service Provider has the right to remove incorrect or non-existent e-mail address provided by the User.

 

§ 5. Personal data

 

  1. The Service Provider is the controller of the personal data processed for the purpose of providing the Service.
  2. Detailed information on the rules of processing the Users’ personal data by the Service Provider is included in the Personal Data Processing Policy at AXELO.

 

§ 6. Complaints and amendments to the Regulations

 

  1. The complaints regarding the Service must be sent to the e-mail address axelo@axelo.pl or by mail directly to the Service Provider’s address.
  2. The complaint must include the personal data of the person lodging a complaint, necessary to send information on the outcome of the complaint reviewing and a description of what the irregularities in the Service consisted in, and what the expectations for the outcome of the complaint are.
  3. The User reviews a complaint within 14 days of its receipt.
  • Any disputes in connection with using the Service may be settled out of court. Detailed information on the possibility for the User who is a consumer to use out-of-court manners of reviewing the complaint and pursuing claims, and the rules for access to those procedures are available at the headquarters and on the websites of the district (municipal) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, Voivodeship Inspectorates of Trade Inspection and at the following websites of the Office of Competition and Consumer Protection:

  1. In the event of any dispute involving the User being a consumer, an on-line platform ODR that is available at the following address: http://ec.europa.eu/consumers/odr/ can also be used to settle it out of court. Using the out-of-court manners of reviewing the complaint and pursuing claims is of a voluntary nature and may only take place when both parties to the dispute give consent to it. The above-mentioned provision is of an informative nature and does not mean that AXELO gives its consent to the participation in out-of-court manners of reviewing complaints and pursuing claims (settlement of disputes).
  2. The Service Provider reserves the right to amend the Regulations if there is a valid reason understood as (closed catalog):
  • amendment to the manner of the Service provision caused by technical or technological reasons;
  • amendment to the provisions of the law regulating the sales of products or the provision of services by electronic means by the Service Provider, affecting the mutual rights and obligations specified in the agreement concluded between the User and the Service Provider or amendment to the interpretation of the above-mentioned provisions of the law as a result of the court judgements, decisions, recommendations or instructions of the authorities or bodies relevant in that regard;
  • amendment to the scope or manner of the Service provision to which the provisions of the Regulations apply, by introducing the new, modifying or withdrawing by the Service Provider the existing functionalities covered by the Regulations.
  1. In the event of any amendments to the Regulations, the Service Provider will make the consolidated text of the Regulations available by its publication on the website.
  2. The amendments to the Regulations are in force from the moment of their clear indication and publication on the Service Provider’s website, however, not earlier than after 14 calendar days from the moment of informing about the amendments to the Regulations, with the proviso that the amended Regulations will be binding on the User, unless the User declares the resignation from the Service within 14 days from the date of receipt of information on their amendments, in case of non-acceptance of the new content of the Regulations.

 

§ 7. Final provisions

 

  1. These Regulations enter into force as of 7 June 2019.
  2. These Regulations are available free of charge at the address https://axelo.pl/regulamin-uslugi-newsletter.html in a form that makes it possible to access, reproduce and record the content of these Regulations by means of the ICT system that is used by the User.
  3. In matters not regulated by these Regulations, the provisions of the laws generally applicable in the Republic of Poland apply.
